Terms of Service

Version 1.2, in force from 18 August 2026
This is a courtesy translation. The Korean text is the authoritative version;
if the two differ, the Korean text prevails.

Article 1 (Purpose)
These Terms set out what you need to know to use Baetnil (the "App").

Article 2 (Operator)
The App is built and run by Kim Myung Joon (contact jaha814@gmail.com) in a personal capacity.

Article 3 (Effect and Amendment)
1. These Terms can be read inside the App at any time.
2. The operator may amend these Terms. Any amendment is announced inside the App and
   your agreement is sought again.
3. If you do not agree to the amended Terms, you may stop using the App.

Article 4 (Contract of Use)
1. A contract of use is formed when you sign up and the operator accepts.
2. You must be 14 or older. Processing the personal data of anyone under 14 requires
   the consent of a legal guardian, and the App has no procedure for that.
   Please add minors who sail with you as crew members under a guardian's account.
3. You may not sign up using another person's name or email address.

Article 5 (What the App Does)
1. The App keeps records of a boat's gear, maintenance, repairs, voyages and fuel;
   manages crew; shows weather and tide information for reference; and provides
   community features including berths, a second-hand market and a message board.
2. Every feature is currently free. Some features may become paid in future.
   If that happens it will be announced inside the App beforehand and Article 12 applies.
   Features you already use for free will not be made paid without notice.

Article 6 (Limits of Weather, Tide and Depth Information; the Decision to Sail)
1. The wind, waves, tide, water level, depth and marine warnings shown in the App are
   all for reference. Weather and tide forecasts can differ from reality, and if your
   internet connection drops you may be looking at older data.
2. The depth, bottom and facility details of a berth are posted by other users.
   The operator does not verify them one by one and they may be wrong.
3. The depth conversion feature is only the value you entered minus the tide.
   It does not replace charted depths.
4. Whether to sail, which route to take, where to lie and when to come alongside are
   entirely your decision and your responsibility. Do not use this App in place of
   charts, notices to mariners, live meteorological warnings or the boat's instruments.
5. The operator is not liable for accidents or losses arising from decisions made in
   reliance on the App, except where the operator acted with intent or gross negligence.

Article 7 (Your Obligations)
You must not:
 1. impersonate another person or use another person's account;
 2. post abuse, threats, hate speech, or material that harasses others;
 3. post false information that endangers others (berths that do not exist, wrong depths and so on);
 4. post repeated advertising or promotion;
 5. post another person's personal data or photographs without their consent;
 6. infringe copyright or other rights of others;
 7. buy or sell goods that are unlawful;
 8. interfere with the normal operation of the App or access it by improper means.

Article 8 (User Content)
1. Rights in the text, photographs and records you post remain yours.
2. The operator uses your content only as far as is needed to run and display the App.
3. Content that breaches Article 7 is hidden automatically once reports accumulate,
   and the operator may delete it.
4. Records inside a boat (gear, maintenance, voyages and so on) can be seen only by that
   boat's crew. Only the items you switch on in the publishing settings leave the boat.

Article 9 (Second-hand Market)
1. The operator only provides the place to trade and is not a party to any transaction.
2. Responsibility for the condition, price, delivery, defects and refund of goods rests
   with the seller and the buyer.
3. The operator does not guarantee transactions and does not hold payments.
4. Do not send money first. See the goods in person before you deal.
5. If a dispute such as fraud arises, please report it to the authorities. On receiving
   a report the operator will take the listing down and suspend the account.

Article 10 (Interruption of Service)
1. The service may stop because of maintenance, faults, communication failures or acts of nature.
2. Interruptions that can be foreseen are announced inside the App.
3. The App is run by one individual and may be discontinued without notice. In that case
   at least 30 days' notice is given and you are able to download your own records.

Article 11 (Suspension and Termination)
1. You may leave at any time.
2. If you breach Article 7 the operator may delete content, suspend you temporarily,
   or restrict your use.
3. If the breach is serious or repeated, the account may be restricted permanently.
4. If you object to any such measure, please tell us through Support.

Article 12 (Paid Services)
1. If paid features are introduced, the price, payment method and refund terms are shown
   on the payment screen beforehand.
2. Refunds follow the Content Industry Promotion Act, the Act on Consumer Protection in
   Electronic Commerce and the Criteria for Resolution of Consumer Disputes.
3. This Article takes effect only when paid features actually exist.

Article 13 (Limitation of Liability)
1. The operator provides the App as it is and does not warrant that it is fit for any
   particular purpose.
2. The operator is not liable for disputes between users or for loss arising from
   information posted by users, except where the operator acted with intent or gross negligence.
3. The same applies to loss arising from a failure of your device, a communication fault,
   or your own failure to look after your account.
4. This Article is not to be construed against the consumer and does not exclude any
   liability the law imposes on the operator.

Article 14 (Governing Law and Jurisdiction)
These Terms are governed by the law of the Republic of Korea. Disputes are brought before
the court determined by the Civil Procedure Act.

Supplementary Provision
These Terms apply from 18 August 2026. (Version 1.2)
